This Policy sets out the measures and practices that RE/MAX du Cartier Bonjour inc. (the "Agency" or "we" or "our") has implemented to govern its personal information management and to protect the personal information of its clients—specifically, the natural persons from whom the Agency collects personal information through direct or indirect contact with an authorized representative of the Agency or through the website https://remaxducartierbonjour.com (the "Website") (the "Clients" or "you" or "your")—for the purposes described in Section 4 below.
In this Policy, the term "personal information" means any information collected by the Agency that allows, either alone or in conjunction with other information, the direct or indirect identification of a Client.
The primary purpose of this Policy is to inform Clients of:
- the methods used by the Agency to collect personal information;
- the nature of the personal information collected by the Agency and the purposes for which it is collected;
- how the Agency may use personal information, as well as the third parties to whom the Agency may communicate this personal information, where applicable;
- your rights regarding the personal information collected by the Agency, including the right to access your personal information or request the rectification of inaccurate personal information, where applicable;
- the various security measures implemented by the Agency to protect the confidentiality of personal information;
- how personal information is stored, destroyed, and/or anonymized; and
- how you can contact the Agency to address your questions, share your comments, or, if necessary, file a complaint regarding this Policy.
By providing one or more pieces of personal information to the Agency through direct or indirect contact with an authorized representative of the Agency or through your use of the Website, you consent to the Agency collecting, using, communicating, and retaining this personal information in accordance with the terms and conditions provided in this Policy.
The Agency reserves the right to modify the terms and conditions provided in this Policy at any time and at its sole discretion. In such cases, the Agency will provide you with a version of this Policy containing the modifications. Your use of the Services (as defined in Section 4 below) following receipt of this version will be deemed to constitute express acceptance of the modifications.
This Policy and any modified version thereof are subject to the legislation applicable in the Province of Quebec.1. By what means does the Agency collect personal information?
The Agency collects personal information through the following means: (i) when such personal information is voluntarily provided to an employee or authorized representative of the Agency in writing, by email, or verbally; (ii) information we collect from other companies and public bodies (including companies within the RE/MAX group to which the Agency is affiliated (RE/MAX Québec inc., RE/MAX Promotional Fund inc., National Relocation Services (RELONAT) inc., and RE/MAX, LLC (Denver, CO)); or (iii) through your use of the Website.
Personal information provided during the use of the Website may be communicated directly (for example, via a web form or an email) or automatically (see the list of automatically collected personal information in Section 3).
2. What personal information does the Agency collect?
The personal information that the Agency may collect includes the following:
- Your last name, first name, and contact information (civic addresses, email addresses, telephone numbers);
- Your date of birth, gender, and preferred language;
- Personal information allowing the Agency, through its authorized representatives, to verify your identity and that of any other person in compliance with applicable legislation in the field of real estate brokerage, including the Real Estate Brokerage Act (CQLR, c. C-73.2) and the Proceeds of Crime (Money Laundering) and Terrorist Financing Act (S.C. 2000, c. 17), as well as their respective regulations, which include, among others:
- Your profession or main occupation;
- An authentic, valid, and up-to-date government-issued photo ID;
- A document from a reliable source containing your name and address, a document from a reliable source containing your name and date of birth, and a document containing your name and confirmation that you hold a deposit account, a prepaid payment product account, or a credit card or other loan account with a financial entity;
- Your citizenship or Canadian residency status;
- Personal information you provide to us as part of the performance of the Services (as defined in Section 4 below) and which may constitute sensitive personal information, such as:
- information regarding your real estate transaction project; and
- financial information necessary to perform credit checks and collect deposits and payments (credit card number, mortgage approval, tax statements, credit investigation reports, etc.);
- Your exchanges and communication history with us (call recordings, chat sessions, and instant messaging conversations, notably via our social media);
- Personal information generated by you in the course of using the Services (complaints, inquiries, notices, comments, and survey responses);
- Personal information provided as part of a job application or engagement with the Agency (curriculum vitae, information on education, professional experience, and professional affiliations);
- Personal information that you are required to, or invited to, transmit to the Agency due to the nature of your relationship with it (for example, if you are a director or employed by the Agency: social insurance number for employees and financial information for employees, photographs of employees for publication on the Website, and identification documents for each of the Agency's directors pursuant to the Act mainly to improve the transparency of enterprises);
- Personal information automatically collected during your use of the Website (see Section 3).
To ensure the functionality of the Website and for the purposes listed below, the Agency must collect the following personal information from Clients visiting the Website:
- The domain name of their Internet service provider;
- Their IP address;
- Their browser (Explorer, Firefox, etc.) and operating system (Windows, Mac OS, etc.);
- The date and time of their visit;
- Their country of origin;
- Pages consulted and the time spent on such consultation;
- The referring site address; and
- Crash data.
4. For what purposes does the Agency collect personal information?
The Agency collects your personal information for the following purposes:
- To provide support, information, advice, and tools related to the real estate transactions you ask us to perform (collectively: the "Services");
- To carry out real estate transactions and be remunerated for our Services;
- To comply with current laws and regulations;
- Within the framework of using the Services, to issue notifications and alerts to provide you with specific information. In doing so, the Agency uses technology that allows for profiling, the functions of which must be activated by the Client from the Website;
- To evaluate your eligibility for programs such as Tranquilli-T: https://www.tranquilli-t.com, Integri-T: https://www.garantie-integri-t.com, and the Key Program: https://quebec.programmecleremax.com, with the goal, among others, of helping you save money and protecting you from latent defects when purchasing your property;
- Generally, to communicate with you to transmit various information related to the Services and to offer products and/or services that may interest you;
- To perform periodic follow-ups with you to ensure you are satisfied with the performance of the Services;
- To develop, improve, and promote the Services, notably by generating and publishing de-identified statistical data from the personal information of multiple Clients;
- To evaluate the effectiveness of the Agency's efforts to acquire visitors to the Website;
- To evaluate what information offered by the Agency and which of its actions generate interest from visitors to its Website;
- To identify which actions of our partner sites led to the acquisition of visitors;
- To improve the performance of the Website and its effectiveness in retaining visitors;
- To identify the legislative regime to which the personal information of visitors is subject; and
- Where applicable, to examine your application for employment or engagement with the Agency.
Subject to the exceptions provided in applicable legislation, the Agency will ensure it obtains your consent before using personal information concerning you for purposes other than those listed above.
5. To whom is the Agency likely to communicate your personal information?In general, the Agency uses the personal information of its Clients for internal purposes only. However, the Agency may communicate personal information concerning you to the following persons or entities:
- To its employees and representatives who need access to this personal information in the pursuit of the purposes listed in Section 4 above;
- To external service providers with whom the Agency has entered into a contractual agreement under which the concerned external service provider is required to take appropriate measures to:
- Ensure the protection of the confidentiality of the personal information communicated;
- Ensure that the personal information communicated is used only for the performance of the services it is called upon to provide for the Agency;
- Ensure that the personal information communicated is not retained after the termination of the aforementioned contractual agreement;
- Notify the Agency without delay of any breach or attempted breach by any person of any obligation regarding the confidentiality of the personal information communicated; and
- Allow the Agency to perform any audit related to the confidentiality of the personal information communicated. For example, the service provider that hosts the Website and performs maintenance on said Website may have access to personal information as part of the specific execution of its services under a contractual agreement binding it to the Agency;
- To the entities forming part of the RE/MAX group to which the Agency is affiliated (RE/MAX Québec inc., RE/MAX Promotional Fund inc., National Relocation Services (RELONAT) inc., and RE/MAX, LLC (Denver, CO)), to the extent necessary to allow the latter to honour its contractual and statutory obligations;
- To any other person or entity, when prescribed or permitted by applicable legislation, or with the consent of the Client concerned.
6. How does the Agency protect the confidentiality of your personal information?
The Agency takes appropriate physical, technological, and administrative protection measures to protect your personal information and reduce the risks of unauthorized and/or illegal access, use, communication, and destruction.
Without limiting the generality of the foregoing, the Agency:
- Verifies the identity and criminal record of all its employees and representatives;
- Requires each of its employees and representatives with access to personal information to sign a confidentiality agreement;
- Implements access control limiting access to personal information to authorized employees and representatives who require access to said information;
- Maintains personal information on physical media kept in locked premises only accessible by authorized employees and representatives of the Agency; and
- Maintains personal information on a secure technological medium, namely the information system provided by electronic document management providers, on which an identification and authentication system is implemented to limit access to your personal information to authorized persons who need such access in the pursuit of one or more purposes listed in Section 4 above.
Furthermore, the Website is equipped with certain security mechanisms intended to protect your personal information, namely:
- All exchanges between RE/MAX servers and user devices are encrypted;
- All user passwords are encrypted;
- The Agency's IT service provider is required to comply with various security obligations involving, notably, a periodic validation of security practices and processes and continuous monitoring and updating of the Website's software components.
The Agency maintains a registry of confidentiality incidents in compliance with applicable legislation. Should a confidentiality incident occur that presents a risk of serious injury to you, the Agency will take the necessary measures to notify you, in compliance with applicable legislation. The assessment of the risk of serious injury is conducted by taking into account criteria such as the sensitivity of the personal information involved in the confidentiality incident, the apprehended consequences of its use, and the likelihood that it will be used for harmful purposes.
8. What is the retention period for your personal information?In accordance with our secure personal information retention and destruction procedures, we only retain your personal information for the period necessary to fulfill the purposes listed in Section 4 of this Policy or for the period required to comply with our statutory obligations, whichever is later.
The Agency reserves the right to close a Client's file once the entire real estate transaction process is completed or, in the case of Agency employees, for a consecutive period of at least seven (7) years from the end date of employment, all subject to a statutory obligation providing for a different minimum retention period. Closing a file involves the complete and final destruction of the personal information it contains, or its anonymization for use for serious and legitimate purposes. In the case of closing a file concerning a Client who is not an employee or representative of the Agency, the personal information it contains will usually be destroyed or anonymized after the expiry of a six (6) year period following the closing date of said file due to legally imposed retention periods.
In this Policy, the term "anonymization" means the process at the end of which personal information no longer, irreversibly, allows for the direct or indirect identification of the Client to whom it relates.9. How can you access, rectify, update, and/or obtain a copy of your personal information?
The Agency recognizes the right of its Clients to access, rectify, update, and obtain a copy of the personal information concerning them by submitting a written request to the Agency at the contact details provided in Section 13 below. Should such a written request be transmitted to the Agency, the Agency must, under the Law, verify your identity and ensure a written response is provided no later than thirty (30) days after receipt of said request. Any request not processed within this period is deemed to have been refused.
A request for rectification of personal information will be granted under certain circumstances, including when:
- The personal information is inaccurate;
- The personal information is outdated;
- The personal information is equivocal;
- The personal information is incomplete; or
- The personal information was collected unjustifiably.
Should the Agency grant a request to obtain a copy of computerized personal information made by a Client, the Agency will ensure that this copy is communicated to them (or to any person or body authorized by law to collect such personal information, as requested by the Client) in a structured and commonly used technological format. This paragraph is inapplicable (i) if the communication of this copy in such a technological format raises serious practical difficulties and/or (ii) regarding any computerized personal information that was created or inferred from other personal information.
Should the Agency refuse to grant a request for access, rectification, or updating made by a Client, the Agency will ensure it communicates to the latter the reasons explaining this refusal as well as the remedies available to the Client in the circumstances and the time limit within which these may be exercised. To the extent required by the Client, the Agency will also provide assistance to help them understand the reasons for the refusal.
Should a written request be sent to it by a Client, the Agency could also cease the dissemination of personal information concerning them and/or de-index or re-index, as the case may be, any hyperlink attached to that Client's name, subject to the criteria established by the applicable legislation then in force.
In principle, the exercise by a Client of a right provided in this section is free of charge. However, reasonable fees may be required from the Client concerned to offset the costs of transcription, reproduction, or transmission of their personal information. In such a case, the Client will be notified of the amount of the fees in question before their request is processed.
10. How to withdraw your consent to the use or communication of your personal information?Subject to your contractual commitments with the Agency and applicable legislation, you may withdraw or modify your consent to the use or communication of your personal information. To do so, you must address a written request to the Agency at the contact details provided in Section 13 below.
Please note that the withdrawal or modification of your consent is likely to impact the Agency's ability to adequately pursue the purposes of the collection of your personal information described in Section 4 of this Policy and could therefore have impacts on our services to you.
11. How to file a complaint?
You may file a complaint regarding our methods, practices, and policies for the protection of personal information by writing to our Person in Charge of the Protection of Personal Information, whose contact details are listed in Section 14 of this Policy.
Any complaint will be handled directly by our Person in Charge of the Protection of Personal Information. A response will be provided to you within 30 days following the complaint. If the complaint is accepted, a brief summary of the changes made regarding the subject of the complaint will be provided to you.
If you are not satisfied with the handling of your complaint, you may also contact the Commission d’accès à l’information du Québec. A written complaint can be filed with the Commission by consulting the following page: https://www.cai.gouv.qc.ca/diffusion-de-linformation/services-et-formulaires/.
12. The protection of your personal information is a priority for all entities forming part of the RE/MAX Québec inc. Group.
